Ethics & Grievances
Information and Guidelines for Members.
( A ) CATEGORIES OF HELP / SERVICES REQUESTED BY MEMBERS.
1 – provide a lawyer, or other legal services directly by AAPI
2 – financial support – either in cash or as a loan – by young physicians, residents and students.
3 – letter of enquiry from Chairperson of EGC or President of AAPI
4 – letter of support – general, or specifically a character reference.
5 – Amicus Brief by AAPI on behalf of a Member.
( B ) SERVICES OFFERED BY ETHICS AND GRIEVANCE COMMITTEE
(1) – Review of all documents upon meeting the conditions below. The review is by a committee of physicians and attorneys who work pro bono for the organization. The information is kept confidential, although submitted material may be shared by members of the Committee:
(a) the person should be a member of AAPI at the time of the Grievance, and should remain so until the final resolution if the issue. This requirement is waived for a student/resident.
(b) the Confidential Physician Information form has to be filled out and submitted to either the AAPI Headquarters or directly to the Chairperson (as an e-mail attachment ), before proceeding further.
2 – assist in research for an appropriate attorney. However, the Committee's role is supportive, and the responsibility for the results of these efforts will be entirely with the Member/Student/Resident/Intern.
3 –request for financial assistance for Students/Interns/Residents only may be submitted through the Ethics and Grievance Committee – to be forwarded to the AAPI Executive Committee. Acceptance of the submitted document should not be presumed to be a promise to provide any monetary services.
4 – in appropriate cases, letters may be issued at the recommendation of the Committee, by the Chairperson of the Ethics and Grievance Committee, or by the President of AAPI. – either of enquiry, support or a demand for explanation, if this is considered beneficial to the Member. Communication with the Member's personal legal counsel may be necessary.
5 – Amicus Brief by AAPI may be requested for by the Member, and will be first considered by the Ethics and Grievance Committee. The recommendations will then be presented to the President of AAPI.
6 - In Internal Issues within AAPI, a grievance can be sent directly, or will be forwarded to the EGC.
C. SERVICES NOT OFFERED BY THE ETHICS AND GRIEVANCE COMMITTEE
i) Private attorney services at AAPI’s expense for an individual case.
ii) Use of AAPI’s Corporate Attorney to pursue individual cases from EGC.
iii) Loan / Financial Services.
(D) STEPS FOR THE GRIEVANCE PROCESS
1 - Contact the Chairperson of EGC - by Phone or Email.
2 - Complete the Physician Information Form, (download it from the members page on AAPI’s
website) and provide all the details which will be helpful to the grievance filed.
3 - A Subcommittee is appointed to review the documents provided ( 2 - 4 persons)
4 - Discussion with the entire Committee if necessary, usually by teleconference.
5 - Recommendations to the Chair of EGC.
6 - Report to President of AAPI.
7 - Member notified of final decision, and Action taken after approval by Member.
